New California Law imposes a New Annual $150 "Fire Prevention Fee"


The State of California will soon start collecting an annual “fire prevention fee” from property owners in wildland areas where the state has responsibility for providing fire protection. A fee of one hundred fifty dollars ($150) will be charged on each structure intended for human habitation in this State Responsibility Area (“SRA”), commencing with the 2011-2012 fiscal year.
The $150 fire prevention fee is not a “per parcel” charge, but is to be levied on each habitable structure on the parcel. For example, a parcel containing one habitable structure would be charged $150, while a parcel with three habitable structures would be charged three times that amount, or $450 each year.
Approximately 850,000 property owners will be affected by the new fee, which affects 56 of the State’s 58 counties. The Board of Equalization will collect the fee from property owners identified in the SRA by the Department of Forestry and Fire Protection (“CalFire”).
Not a “firefighting fee”
The new law, based on Assembly Bill X1 29, is very clear about the fee’s intended purpose. The moneys collected will create an “SRA Fire Prevention Fund”, which will be used for specified “fire prevention” activities that will benefit the owners within the SRA who are required to pay the fee. The bill does not earmark any portion of the fee for firefighting services.
FANHD already discloses when a property is within the SRA. With this new levy, our report now also includes a special “State Responsibility Area Fire Prevention Fee Disclosure”.
The new disclosure is in the Tax Report section of FANHD's combined report packages. It explicitly notifies the buyer whether the property is subject to the annual $150 fire prevention fee per habitable structure as determined by the State.

Senate Bill 183 - Requires that carbon monoxide (CO) detectors be installed in most single-family homes!

Beginning January 1, 2011 - This bill requires that a carbon monoxide device be installed in existing dwellings intended for human occupancy that have a fossil fuel burning appliance, fireplace, or an attached garage, provides that the exclusive remedy for failure to install a device is actual damages not to exceed $100, exclusive of any court costs and attorney's fees, revises the statutory Real Estate Transfer Disclosure Statement to require the seller of a one-to-four residential property or manufactured home to make certain disclosures regarding carbon monoxide devices, smoke detectors, and water heaters, and requires the owner of a rental dwelling unit to maintain carbon monoxide devices in the unit.

Orange County Housing Report: A Great Time to Be a Buyer

Values have dropped, rates are low, and it’s a buyer’s market. If you are a buyer, what are you waiting for?

Buyer’s Market: Buyer’s should not wait for a seller’s market to purchase.
Markets go up and markets go down. Isn’t it odd that buyers rush to purchase when the market is climbing in fear that they will be left behind. They enter a market where there is tremendous competition and, often, they feel rushed to settle on a home that may not fulfill their wish list. Yet, as markets climb, affordability drops until it finally reaches a point where demand drops, cooling price appreciation. The current market is completely different. It’s a buyer’s market where values have already dropped over 30%. Affordability has been restored and interest rates are at all time lows. Current interest rates improve home affordability dramatically. The historically record low rates translate to the lowest possible monthly payments. Unfortunately, buyers just don’t shop based upon the monthly payment. Too much emphasis is paid on the purchase price and not enough on payments. People shop for cars based upon the monthly payment. Why not homes? As new homeowners mail off their monthly mortgage payment, wouldn’t they rather pay a few hundred dollars less? How about $1,000 less? Cashing in on today’s rock bottom interest rates saves anywhere from hundreds of dollars to over a thousand dollars per month, depending upon how high interest rates will climb. As the market improves interest rates WILL GO UP. This is the absolute best time to purchase, during a buyer’s market. The buyer’s market will not be around forever.

Market Changes: The real estate market will move along its normal cyclical pattern, but don’t expect abnormal changes.
I am often asked where I think the market is going from here. Regardless of what you hear or read in the news, the market is not going to drop off a cliff or skyrocket anytime soon. What you see is what you get, a lot more of the same. For the coming years, the real estate market is not going to change much at all. As a buyer, holding out for another 10% drop is not wise. Values have already dropped over 30% and today’s affordability has propped up demand, keeping values stable. Likewise, for sellers that need to sell and are waiting for real price appreciation, they may have to wait a few years. Boring is the new normal. The market will slow during the Holiday market, from Halloween through the first few weeks of the New Year. It will pick up in the Spring, cyclically the best demand of the year. Then it will cool a bit during the summer. There are no more surprises. It will take a few years to exhaust the infamous “shadow inventory” of homeowners in default. The market has already been slowly working its way through the shadows already. As a buyer or seller, expect more of the same. It really is what you see is what you get.

Tickets are now on sale for this fun and tasty event.

The Huntington Beach Masonic Lodge has a huge deep-pit barbeque that is filled with delicious seasoned pork and beef roast wrapped in cheese cloth, then burlap. The meats are slowly cooked overnight and then transported down the block to the park just in time for the BBQ. This event is designed for the entire family.

The cost is only $10 per person for all you can eat or until the food runs out. Other included items: roasted garlic bread, potato and macaroni salads, watermelon, ice tea, lemonade and coffee. Leftovers are usually sold by the pound towards the end of the event.

Members of Eastern Star, Demoley and Job’s Daughters usually sell homemade crafts, deserts, and sodas.

DJ and Live music, games and entertainment provided. Plus The El Bekal Shrine Clowns and Steel Drum Band will be performing.

You don't have to be a member to attend, everyone is welcomed!

2009 A.C.S. Relay for Life of Huntington Beach


Description: Participate in the fight against cancer by forming a team and soliciting sponsors to support your efforts. In this 24 hour relay, each team is tasked with having someone on the track at all times. Teams can dress up in themed costumes, and a festive atmosphere lends to the event, which will include picnicking, tent camping, silent auctions and great entertainment.

Many Home Buyers Need Higher Loan Limits, Upper-End Stalled


WASHINGTON (January 15, 2009) – The drop in mortgage loan limits for conventional financing at the end of 2008 is hurting home sales and trade-up activity in higher price ranges across the country, according to the National Association of Realtors®.
The latest existing-home sales data shows transactions under $400,000 are 3 percent below a year ago. However, sales of homes priced at $750,000 or more have declined a whopping 47 percent.
Outside of FHA, Fannie Mae and Freddie Mac, mortgages that do not have government backing are still experiencing a credit crunch. Buyers who need jumbo mortgages must pay interest rates that are nearly 2 percentage points higher than conventional financing; as a result, the high-end market is not moving.
Lawrence Yun, NAR chief economist, said restoring higher mortgage loan limits is critical to this part of the market. “Buyers in higher price ranges are at a severe disadvantage because they have to pay higher interest rates,” he said. “Lower loan limits are having a pronounced impact on trade-up activity at the upper end of the market, which depends more on large downpayments to keep mortgage amounts below the maximums for conventional financing.”
While homes above $750,000 are considered luxurious in many areas, they are modestly sized homes in the midprice ranges of many high-cost markets. “However, the lower mortgage limits for conventional loans mean upper middle-class home buyers in much of the country, including many areas in the Midwest and South, also have to pay higher interest rates,” Yun said. “As a result, we are seeing a universal stalling of sales in higher price ranges across the country.”
To illustrate in dollar terms, if mortgage limits are permanently raised to $729,750, the maximum limit that expired at the end of December, the mortgage payment on such a loan would drop by $942 per month by lowering interest rates 2 percentage points. Over the life of a 30-year loan, the homeowner would save $338,000.
NAR President Charles McMillan, a broker with Coldwell Banker Residential Brokerage in Dallas-Fort Worth, said all consumers should have access to today’s historically low mortgage interest rates. “It’s only fair that all hard-working, tax-paying, successful people who want to purchase a home have equal access to low interest rates regardless of where they live or where they want to buy,” he said.
“Every segment of the housing market needs a turnaround to spark an overall housing recovery, which will help the economy to begin to recover,” McMillan said.

The City of Huntington Beach and its Centennial Celebration were well represented by the spectacular “Surf City USA” Float in the 2009 Tournament of Roses® Parade. The float, measuring 55 feet long and 30 feet high and featuring a family barbequing on a surfboard, won the prestigious Mayor’s Award, representing the Most Outstanding City Entry.

The “Surf City USA” float embodied the essence of living in Huntington Beach featuring family, ocean life and even the famous Huntington Beach pier. Singing and dancing along with the float to the tune of “Surf City” by Jan and Dean were 38 members of Huntington Beach High School’s APA program.
Millions of spectators around the world enjoyed the beautiful pageantry and magnificent floats of the 120th Tournament of Roses® Parade, themed “Hats off to Entertainment”, and the City of Huntington Beach is proud to be a part of such a great tradition.

Tournament of Roses® Parade History
The Tournament of Roses® has come a long way since its early days. The first Tournament of Roses® was staged in 1890 by members of Pasadena's Valley Hunt Club, former residents of the East and Midwest eager to showcase their new home's mild winter weather. During the next few years, the festival expanded to include marching bands and motorized floats. The games on the town lot (which was re-named Tournament Park in 1900) included ostrich races, bronco busting demonstrations and a race between a camel and an elephant (the elephant won). Reviewing stands were built along the Parade route, and Eastern newspapers began to take notice of the event.
In 1895, the Tournament of Roses® Association was formed to take charge of the festival, which had grown too large for the Valley Hunt Club to handle. The Parade’s elaborate floats now feature high-tech computerized animation and exotic natural materials from around the world. Although a few floats are still built exclusively by volunteers from their sponsoring communities, most are built by professional float building companies and take nearly a year to construct. The year-long effort pays off on New Year's morning, when millions of viewers around the world enjoy the Parade.

Surf City USA Float Riders
Over 500 residents entered a drawing to ride on Huntington Beach’s first float in the 2009 Tournament of Roses® Parade. The lucky winners, chosen at the city council meeting on October 6th , were a very special part of the city’s Centennial kickoff on New Year’s Day riding the spectacular “Surf City USA” Float.

Patricia Pashich has been living in Huntington Beach since 1992 and grew up just off the Rose Parade route.

Kenneth Bauer works for OCTA and has been a Huntington Beach resident for over 35 years.

Anita Jones, a 20 year resident, attended Huntington Beach High School and owns her own local accounting and marketing business.

Debbie DeBow has been working for the City of Huntington Beach in the Public Works department for almost 17 years.

Catherine Wippler is the junior lifeguard representative and has lived in Huntington Beach her whole life.

Araceli Arizmendi is a Youth Character Award recipient and attends Oceanview High School.

The residents were joined on the float with Mayor elect Keith Bohr and the 2008 Miss Huntington Beach Cayce Crowder.

Volunteers made the float spectacular
The City of Huntington Beach would like to thank the hundreds of volunteers who helped with float decoration during December at the Huntington Beach Art Center and at Festival Artists in Azusa. Every flower cut and bean glued helped to make the Surf City, USA float spectacular!

Volunteers decorated the float in Azusa and many more groups and residents did dry preparation at the Huntington Beach Art Center including the 4H club, girl scouts, and the Shore Break Hotel.
Dry preparation included cutting petals off statice flowers, chopping dried papaya and gluing materials on to the starfish and coral featured on the float. Other materials decorating the float include black seaweed, green moss and red carnations.

Surf City's 11th Annual O.C.S.P.C.A.'s Walk for the Animals


Description: Over 400 animal lovers and dogs for a morning of fun at the 11th Annual Walk for the Animals to benefit the Orange County Society for the Prevention of Cruelty to Animals. Registration begins at 7:30 AM and the 2K/5K walk starts at 9:00 AM. Collect pledges and win prizes while raising funds to support our programs which directly benefit the animals. Activities following the walk include, entertainment by Disc Dogs in Southern California, dog contests, dozens of sponsors and vendor booths, a silent auction, Pick Your Prize drawing and many fantastic door prizes! Low cost AVID micro-chipping will also be available. The OC SPCA is a non-profit organization and depends on donations and events such as these. All funds raised from the walk help support the organization’s programs including veterinary care for sick and injured animals, subsidized spay/neuter, feral cat rescue, cruelty prevention through humane education in the classroom and pet-assisted therapy. Well-mannered dogs, on leashes, are welcomed to attend. No puppies under six months please!


Registration: $20.00 by September 6th and $25.00 thereafter. Kids under 12 are free. (Teams of five or more pay $15.00 each if pre-registered by September 6th.)
